1. Introduction
At Franks Motorcycles Limited, we comply with the Consumer Contracts (Information, Cancellation
and Additional Charges) Regulations 2013, commonly referred to as the Distance Selling
Regulations. This policy outlines your rights and our conditions for returning a vehicle purchased
remotely.
This return policy applies only to vehicles purchased without face-to-face contact before the contract
is concluded.
2. Right to Cancel and Return
If you have purchased a vehicle from us via distance selling (e.g., online or over the phone) without
physically inspecting it at our premises, you have the right to cancel your purchase within 14 days
from the date of delivery.
To exercise your right to cancel, you must notify us in writing via email or letter within this period.
3. Conditions of Return
To qualify for a full refund, the following conditions must be met:
- The vehicle must not be used beyond what is necessary to establish its nature, characteristics, and
functioning.
- The vehicle must not be altered or modified in any way.
- The vehicle must not be damaged, either cosmetically or mechanically.
- The vehicle must be returned in the same condition as received, with all original documentation,
keys, and accessories.
- The return must be at your own cost, including any necessary transport arrangements.
4. Return Process & Inspection
- The vehicle must be returned to our premises at the customer's expense. Alternatively, we can
arrange collection for a fee, which will be deducted from the refund amount.
- Upon return, we will inspect the vehicle to ensure it meets the conditions stated above.
- Any excessive mileage or signs of use beyond reasonable inspection may result in a deduction
from the refund to reflect any depreciation in value.
- If damage, modifications, or excessive use are identified, we reserve the right to reject the return or
apply reasonable deductions to cover repair costs.
5. Refund Process
- Once the vehicle is returned and passes inspection, we will process your refund within 14 days.
- Refunds will be issued to the original payment method.
- The refund amount will be the full purchase price minus any applicable fees for delivery, collection,
or deductions for damage or depreciation.
6. Customer Responsibilities
- It is your responsibility to arrange and cover the cost of returning the vehicle.
- The vehicle must be stored and transported securely to prevent damage.
- Any damage incurred during return transport will be the customer's liability.
7. Statutory Rights
This policy does not affect your statutory rights under the Consumer Rights Act 2015. If a vehicle is
found to be faulty or misrepresented, you may be entitled to a repair, replacement, or refund beyond
the cancellation period.
